The case reached the Supreme Court in 1999, at which time the court determined that under the ADA (Americans with Disabilities Act), it is illegal for states to discriminate against individuals based on their disabilities. This means that any individual with a disability, such as I/DD, has the right to receive treatment in an integrated setting provided: 1) that’s what the individual wants; 2) their doctors agree an integrated setting supports treatment; and 3) doing so won’t impact how the state provides services to others.
Since 1999, the Olmstead decision has lead to continuous updates and changes at the state level. The most recent update occurred in 2018 when new compliance oversight guidelines were established. These guidelines focus on ensuring the safety, health, and wellbeing of individuals living in group home environments.
